Being a Commercial Real Estate Advisor and Broker is not just a job or a way to make money to us. It is a Lifelong Profession and commitment. We conduct ourselves just as a Doctor, Lawyer, CPA, or any Professional should. We owe our clients a fiduciary duty to always keep their interest above ours, even when it costs us time and money to do so.
For this reason, we have adopted a Code of Ethics (Code) that we modified from the National Association of Realtors Code. iMark’s Code has abbreviated, clarified, simplified, and in places expanded this Code so it is a meaningful and usable document for us and for you. We prominently display this Code on our website and in our offices not only for our clients to review, but as a constant reminder to us.
Article 1 – Promote the interests of our client above ours and always be honest and fair with all our business dealings.
Article 2 – Avoid exaggeration, misrepresentation, and concealment.
Article 3 – Cooperate with other brokers, as long as it is in the best interest of our clients.
Article 4 – Disclose our official capacity and any special interests in all real estate dealings.
Article 5 – Disclose any potential conflicts of interests when providing professional services.
Article 6 – Disclose to clients any and all commissions, rebates, profits, benefits, or fees contemplated or earned from other parties in a transaction.
Article 7 – Disclose any fees contemplated or earned from more than one party to a transaction.
Article 8 – Keep an account, separate from our own and in trust, for other people’s money.
Article 9 – Attempt to make all agreements clear, understandable, comprehensive, and in writing. A copy should be given to each party involved in the transaction.
Article 10 – Do not discriminate based on age, race, color, religion, sex, handicap, familial status, or national origin.
Article 12 – Make all representations clear and true and disclose our professional status.
Article 13 – Do not give legal advice and recommend a client seeks legal advice from a qualified attorney.
Article 14 – Cooperate with any Code of Ethics proceedings.
Article 15 – Do not make reckless or misleading comments about competitors.
Article 16 – Respect exclusive agency agreements and relationships that other Realtors have with potential clients.
Article 17 – In the event of a dispute, make every attempt to Arbitrate or Mediate rather than Litigate.
